The Assam Rising — Talent Search Exam
1. Acceptance of These Terms
These Terms and Conditions ("Terms") govern access to and use of the website talent.theassamrising.com and all related services (together, the "Platform"), operated by [Legal Entity Name, e.g. "Aviyantrik Scholarship Foundation"] ("we", "us", "our").
By registering on the Platform, taking any examination through it, or otherwise using it, you (or, where you are under 18, your parent or legal guardian on your behalf — see Section 6) agree to be bound by these Terms. If you do not agree, please do not use the Platform.
We may update these Terms from time to time. Where a change is material, we will post a notice on the Platform for at least 7 days before it takes effect. Continued use of the Platform after that period constitutes acceptance of the revised Terms.
2. What the Platform Does
The Assam Rising Talent Search Exam is a merit-based scholarship program open to students from Class 4 onwards. The process works as follows:
- Registration — you create an account and verify your email address.
- Preliminary Exam — an online, proctored exam for your class group. A qualifying score (currently 90%+, subject to change) is required to advance.
- School Certificate Verification — you upload a school-issued certificate, which our team manually reviews and approves.
- Scholarship Exam — available only after the above two steps are complete, leading to scholarship awards for qualifying students.
We may change exam content, qualifying thresholds, class-group eligibility, scholarship amounts, or any other aspect of the program at our discretion, with reasonable notice on the Platform where the change affects students who have already registered.
3. Registration & Account Responsibilities
When you register, you agree to:
- provide accurate, current information (student name, class, contact details, and — for the parent/guardian account holder where applicable — your own verified details);
- keep your login credentials confidential and not share your account with anyone else;
- promptly update your information if it changes;
- take responsibility for all activity that occurs under your account, including exam attempts.
We may suspend or terminate an account where information provided is false, incomplete, or where the account is being used by someone other than the registered student.
4. Examination Integrity
To keep results fair and credible for every student:
- Exams may run in proctored mode, which can include fullscreen enforcement and automatic submission after repeated attempts to leave the exam window. By starting a proctored exam, you consent to this monitoring for the duration of that exam only.
- Each exam may have a maximum number of attempts as configured for that exam; once that limit is reached without a passing score, no further attempts on that exam will be permitted.
- You must complete exams yourself, without impersonation, unauthorized assistance, or use of external tools or materials not expressly permitted for that exam.
- We reserve the right to invalidate a result, revoke a certificate, or suspend an account where we reasonably believe these integrity rules were violated.
5. Fees & Payment
- Registration is free. Certain steps (for example, the Preliminary Exam) may carry a fee, which varies by class group and is displayed before you pay.
- Payments are processed through our third-party payment gateway. We do not store your card or payment credentials — that is handled entirely by the gateway provider.
- Fees are charged per attempt, not as a recurring subscription. There is no auto-renewal on this Platform.
- Prices are shown in Indian Rupees (INR) inclusive of any applicable taxes unless stated otherwise, and may change at any time for future purchases; a change will not affect a payment already completed.
6. Minors & Parental Consent
Many students using this Platform are under 18. Under India's Digital Personal Data Protection Act, 2023 ("DPDPA"), we are required to obtain verifiable consent from a parent or legal guardian before processing a minor's personal data.
- Where the student is a minor, the account must be registered and operated with the involvement of a parent or legal guardian, who is treated as the "data principal" for consent purposes under the DPDPA.
- By completing registration for a minor student, the parent/guardian confirms they have the authority to give this consent and that the information provided is accurate.
- We will not use a minor's data for behavioural monitoring, targeted advertising, or any purpose beyond operating the exam and scholarship program, tracking results, and communicating with the registered parent/guardian about the student's progress.
- A parent or guardian may withdraw consent and request deletion of the student's data at any time (see Section 10), subject to our need to retain records required by law or for resolving disputes about results already awarded.
7. Cancellation & Refund Policy
- All payments are final. Once a payment is completed for an exam attempt or any other paid feature on the Platform, it is non-refundable — regardless of whether the exam is started, completed, or not attempted at all, and regardless of the result.
- Please review the class group, exam type, and fee carefully before paying, as no cancellation requests will be accepted after payment.
- This policy does not cover a case where payment was deducted by the payment gateway but the transaction itself failed to register on the Platform (i.e. you paid but received no access at all due to a technical fault) — in that specific situation, contact us at [support email] with your payment reference so we can investigate and correct it.
8. Certificates
- A certificate is issued automatically upon successfully passing an exam, in the name and details provided at registration. You are responsible for the accuracy of the name entered — we are not liable for reprinting costs due to a name entered incorrectly at registration, though we will make reasonable efforts to assist with corrections.
- Each certificate carries a unique Certificate ID and can be verified at talent.theassamrising.com using that ID. Do not share your Certificate ID with anyone you don't want to be able to look up your result.
- Certificates, and the design, logos, and seals they contain, remain our intellectual property. You may use your own certificate for personal, educational, or scholarship-application purposes, but may not alter it or represent it as issued by any other organization.
9. Acceptable Use
You agree not to:
- attempt to access another student's account or exam session;
- use bots, scripts, or automated tools to interact with the Platform;
- attempt to bypass proctoring, attempt limits, or exam timing;
- upload content that is false, defamatory, obscene, or infringes someone else's rights (for example, a fraudulent school certificate);
- probe, scan, or attempt to breach the security of the Platform.
We may suspend or terminate access, and where appropriate report conduct to relevant authorities, for violations of this section.
10. Data & Privacy
Use of the Platform is also governed by our Privacy Policy at [link to Privacy Policy], which explains what data we collect, why, and how it is protected, in line with the DPDPA and the Information Technology Act, 2000.
In brief:
- We collect the data needed to operate registration, exams, certificates, and scholarship verification — this includes student name, class, contact details, exam responses/scores, and uploaded school certificates.
- Data is not sold to third parties. It may be shared with payment gateway providers (for processing fees) and, where legally required, with authorities.
- A parent/guardian (for a minor student) or an adult student may request a copy of their data or its deletion by emailing [support/privacy email], subject to retention needed for legal or dispute-resolution purposes.
11. Intellectual Property
All exam questions, course content, branding, certificate designs, and site content are our property or that of our licensors. You may not copy, redistribute, republish, or use exam content for any purpose outside taking the exam itself — including sharing questions with other students or third parties.
12. Disclaimers
The Platform is provided "as is." We do not guarantee that the Platform will be uninterrupted, error-free, or available at all times, and we are not responsible for results affected by your own device, internet connection, or browser issues. To the extent permitted by law, we make no warranty, express or implied, regarding the Platform's fitness for a particular purpose.
13. Limitation of Liability
To the fullest extent permitted by Indian law, our total liability to you for any claim arising from your use of the Platform is limited to the amount you paid us for the exam attempt(s) giving rise to the claim in the preceding 12 months. We are not liable for indirect or consequential losses, including loss of opportunity to compete for a scholarship due to a missed deadline or technical issue outside our reasonable control.
14. Indemnification
You (or, for a minor student, the registering parent/guardian) agree to indemnify and hold us harmless from claims, losses, or damages arising from a breach of these Terms, misuse of the Platform, or false information provided during registration or certificate upload.
15. Termination
We may suspend or terminate your access at any time for a violation of these Terms, exam integrity rules, or applicable law. You may close your account at any time by contacting [support email]; this does not entitle you to a refund for attempts already completed or scholarship results already determined.
16. Grievance Redressal
In accordance with the Information Technology Act, 2000 and the DPDPA, our Grievance Officer can be reached at:
